1. General information

    1. These terms and conditions apply to every offer by My Sweet Little Angel and every contract concluded between My Sweet Little Angel and the consumer. The terms and conditions are available to all and contained on the My Sweet Little Angel website. We will send you a written copy upon request.

    2. By placing an order, you confirm that you agree to the terms of delivery and payment. My Sweet Little Angel reserves the right to change the terms of delivery and/or payment after the expiry of the term.

    3. Unless otherwise agreed in writing, My Sweet Little Angel does not accept any general or specific terms or conditions of third parties.

    4. My Sweet Little Angel warrants that the product supplied complies with the contract and the specifications stated in the offer.

  2.  Delivery
    1. Delivery shall take place until stocks are exhausted.
    2. According to the terms of the remote purchase My Sweet Little Angel will perform the order at least within 30 days, unless another delivery date has been agreed. If delivery within 30 days or as otherwise agreed (because the order is not available or cannot be delivered), or there is a delay for other reasons, or the order cannot or can only be partially delivered, in which case the consumer will be informed within 1 month and in that case he has the right to cancel the order without cost or notice of default.
    3. The obligation to deliver My Sweet Little Angel will be fulfilled, unless proven otherwise, once the goods delivered by My Sweet Little Angel are offered to the Buyer once. In the case of home delivery, the freight forwarder’s statement, including refusal of acceptance, shall constitute complete proof of the offer to deliver
    4. All periods mentioned on the website are indicative. No rights can therefore be derived from the above periods.
    5. The consignee is responsible for providing correct data when placing an order.


  3. Prices

    1. Prices shall not be increased during the offer unless required by law or if the manufacturer applies temporary price increases.

    2. All prices on the website are subject to printing and writing errors and we are not liable for these errors.

    3. All prices on the website are given in euros and include 21% VAT.

  4. Trial period / right of withdrawal

    1. In the case of a consumer purchase, according to the Distance Selling Act (Art. 7: 5 of the Netherlands Civil Code), the customer has the right to return (part of) the delivered goods within 14 days without giving any reason. This period begins with the delivery of the ordered items. Before proceeding with the return, the customer must notify My Sweet Little Angel in writing within 14 days of receipt and return the articles.

      The purchase must be cancelled using the return form, which can be found under the return heading. The product must be returned unused and unopened (well packed). In the event of termination, the trader will refund the amount paid by the consumer as soon as possible, but no later than 14 days after termination. The trader will use the same payment method as the consumer used to obtain the refund, unless the consumer agrees to another method. No fees shall be payable by the consumer for the reimbursement. If the buyer does not notify the right of return during the trial period of 14 days after receipt, the purchase becomes a reality.

      During the withdrawal period, the consumer will handle the product and the packaging carefully. He will unpack or use the product only to the extent necessary to assess its nature, characteristics and performance. If he exercises his right of withdrawal, he will return the product to the trader within 14 days after cancelling the order, according to clear instructions provided by the trader.

      The consumer shall only be liable for any diminished value of the product resulting from the handling of the product which goes beyond what is allowed under the previous subparagraph.

      The customer must prove that the delivered goods were returned on time, for example by means of proof of delivery to the post office. The goods must be returned in their original packaging (including accessories and accompanying documentation) and in unused condition. If the goods have been used, charged or damaged in any way by the customer, My Sweet Little Angel retains the right to charge for depreciation. With due observance of the previous sentence My Sweet Little Angel will refund the payment within 14 days after the correct receipt of the return shipment or 14 days after the confirmation of the return (the contents of the return shipment must be clearly indicated on the proof of dispatch). Upon return of the entire purchase, the full purchase amount, including any calculated shipping and/or payment costs, will be returned to the buyer. If only part of the received purchases are returned, only the purchase value of the returned items will be returned. Additional costs due to the more expensive shipping method than the cheapest standard delivery will not be refunded.
      The return of the delivered goods is done only at the account and risk of the buyer.

    2. The right of withdrawal does not apply:

      • service contracts, after the service has been fully performed and only if the performance has begun with the consumer’s express prior consent and the consumer has stated that he loses his right of withdrawal after the trader has fully performed the contract;

      • goods or services whose price depends on fluctuations in the financial market which are outside the control of the supplier and which may occur during the withdrawal period

      • goods which have been made to the consumer’s specifications, for example custom-made works, or which are clearly personal in nature

      • products whose expiry date has expired within 14 days of withdrawal (spoilage).

      • sealed products which are not suitable for return for health or hygiene reasons and whose seal has been broken after delivery

      • cosmetic products that are open

      • for goods or services which cannot be returned due to their nature, e.g. hygienic measures, products which deteriorate rapidly or are useless.


  5. Data protection

    1. If you place an order with My Sweet Little Angel, your details will be included in the My Sweet Little Angel customer file. My Sweet Little Angel complies with data protection legislation and will not pass on this information to third parties. See our privacy policy.

    2. My Sweet Little Angel respects the privacy of the users of the website and ensures the confidentiality of your personal data.

    3. In some cases My Sweet Little Angel uses a mailing list. Each correspondence contains instructions on how to delete your data from this list.


  6. Warranty and compliance

    1. The Entrepreneur guarantees that the products and/or services are in accordance with the contract, specifications given in the offer, justified requirements for reliability and/or usability and the legal regulations in force at the date of the contract and / or governmental regulations.

    2. The program offered by the trader, manufacturer or importer as a guarantee does not affect the rights and claims that the consumer may assert in connection with a shortcoming in the performance of the trader’s obligations to the trader under the law and / or distance contract.

    3. If it is found that the goods delivered are incorrect, inappropriate or incomplete, then the customer (before returning them to My Sweet Little Angel) must report these defects in writing to My Sweet Little Angel within 2 weeks of the defect being discovered. Goods must be returned in their original packaging (including accessories and accompanying documentation). Commissioning after the discovery of a defect, damage after the discovery of a defect, encumbrance and/or resale after the discovery of a defect completely invalidates the right of complaint and return.

    4. If the customer’s complaint is deemed justified by My Sweet Little Angel, My Sweet Little Angel will repair or replace the goods supplied free of charge at the consumer’s discretion. Any liability of My Sweet Little Angel in the event of damage shall be limited to an amount not greater than the invoice for the goods in question or (at My Sweet Little Angel’s option) to the maximum amount covered by My Sweet Little Angel’s liability insurance in the relevant case. Any liability of My Sweet Little Angel for any other form of damage is excluded, including additional compensation in any form, compensation for indirect or consequential damages or damages resulting from lost profits.

    5. My Sweet Little Angel shall not be liable for damages caused by intentional or equivalent recklessness of non-management personnel.

    6. This warranty does not apply if: A) as long as the buyer has not fulfilled its obligations to My Sweet Little Angel; B) the buyer has repaired and/or modified the goods supplied by itself or has had them repaired or modified by third parties. C) the delivered goods have been exposed to abnormal circumstances or have otherwise been treated negligently or used contrary to My Sweet Little Angel and/or the instructions on the packaging;


  7. Offers

    1. Tenders are non-binding, unless otherwise specified in the tender.

    2. Oral commitments shall only commit My Sweet Little Angel after they have been expressly and in writing confirmed.

    3. My Sweet Little Angel’s offers do not apply to automatically recurring orders.

    4. My Sweet Little Angel cannot be held liable for the fact that an offer or part of it contained a manifest error or mistake, which the buyer shall take into account.

    5. Additions, amendments and/or further agreements are only valid if agreed upon in writing.

    6. By accepting the terms and conditions, the buyer automatically agrees to the conditions related to the Black Friday promotion.

  8. Contract

    1. The contract between My Sweet Little Angel and the customer shall be entered into after the My Sweet Little Angel order has been evaluated for feasibility.

    2. My Sweet Little Angel reserves the right to reject orders or orders without giving any reason.


  9. Photos and specifications

    1. All images; photographs, drawings, etc.; including information on weights, dimensions, colours, label images, etc. on the My Sweet Little Angel website are approximate only, are indicative and cannot constitute grounds for compensation or termination.

  10. Force Majeure.

    1. My Sweet Little Angel shall not be liable if and insofar as its obligations are not met due to force majeure.

    2. Force Majeure shall mean any foreign cause as well as any circumstance giving rise to risk. Delays or failures of our suppliers, internet disruptions, power disruptions, disruptions of e-mail traffic and disruptions or changes in technology supplied by third parties, transport difficulties, strikes, government measures, delays in delivery, negligence of suppliers and / or producers of My Sweet Little Angel as well as auxiliary staff, staff diseases, defects in assistance or means of transport are expressly considered as force majeure.

    3. In the event of force majeure My Sweet Little Angel reserves the right to suspend its obligations and is also entitled to terminate the contract in whole or in part, or to demand that the content of the contract be amended so that it can be fulfilled. Under no circumstances shall My Sweet Little Angel be obliged to pay a fine or damages for this.

    4. If at the commencement of the force majeure My Sweet Little Angel has already partially fulfilled its obligations or can only partially fulfil its obligations, My Sweet Little Angel shall be entitled to issue a separate invoice for the part or parts already delivered, and the customer shall be obliged to pay this invoice as a separate contract was concerned. However, this does not apply if the part already delivered or to be delivered has no independent value.

  11. Liability

    1. My Sweet Little Angel shall not be liable for damage to vehicles or other objects caused by misuse of the products. Read the instructions on the packaging and/or consult our website before use.

    2. My Sweet Little Angel shall not be liable for loss of packages or incorrect delivery of orders if the customer gives the wrong address in his order.

  12. Reservation of title

    1. Ownership of all items sold and delivered by My Sweet Little Angel to the buyer shall remain with My Sweet Little Angel as long as the buyer has not paid My Sweet Little Angel’s claims under the agreement or previous or subsequent similar agreements, as long as the buyer has not paid the claims for work performed or to be performed under these or similar agreements and as long as the buyer has not paid My Sweet Little Angel’s claims under such obligations as fines, interest and costs as referred to in Section 3:92 of the Netherlands Civil Code.

    2. Goods supplied by My Sweet Little Angel which are subject to retention of title may only be resold in the normal course of business and may never be used as a means of payment.

    3. The customer shall not be entitled to pledge the goods subject to retention of title or to charge them in any other way.

    4. The Customer already gives the unconditional and irrevocable consent of My Sweet Little Angel or a third party appointed by My Sweet Little Angel to the effect that in all cases in which My Sweet Little Angel wishes to assert its proprietary rights it will be able to enter all places where its property is located and to take it from there.

    5. If third parties seize the delivered goods subject to retention of title or wish to establish or enforce their rights, the buyer is obliged to inform My Sweet Little Angel as soon as possible.

    6. The buyer undertakes to insure the delivered goods subject to retention of title and to protect them against fire, explosion and water damage as well as against theft and to provide this insurance policy for inspection by My Sweet Little Angel upon first request.

  13. Complaint procedure

    1. The trader has a complaint procedure properly specified and deals with complaints under this procedure.

    2. Complaints about the performance of the contract must be fully and clearly described and submitted to the trader within 7 days after the consumer has detected the defects.

    3. Complaints submitted to the trader will be answered within 14 days of receipt. If the complaint requires a longer expected response time, the trader will respond within 14 days with an acknowledgement of receipt and an indication of when the consumer can expect a more detailed response.

    4. A complaint does not suspend the trader’s obligations unless the trader indicates otherwise in writing.

    5. If the trader considers the complaint to be justified, the trader will, at his discretion, either replace or repair the products supplied free of charge.

  14. Applicable law / competent court

    1. Dutch law applies to all contracts.

    2. Disputes arising from the contract between My Sweet Little Angel and the buyer which cannot be resolved by mutual consent shall be settled by the competent court of the district of Lelystad, unless My Sweet Little Angel prefers to settle before the competent court of the place of residence of the buyer, except for disputes falling under the jurisdiction of the district court.
